UK Education Scheme Rules

• These Hays Refer a Friend scheme rules and the terms and conditions below constitute the entire agreement between the parties. In the event of conflict between this Refer a Friend scheme rules and the terms and conditions, the terms and conditions shall prevail.
• This Scheme is valid from 09:00 on 26th January 2024. The closing date is 09:00 on 31st October 2024. Referral entries received after this time will not be accepted.
• The gift for this scheme is a £350 retail voucher. Each valid referral entry will automatically be entered into a prize draw to win a £500 retail voucher. This prize draw is subject to the Additional Terms set out below.
• Excludes candidates currently registered with Hays
• No monetary alternative is available
• Referrals must be made to Hays before or at registration (of the referred candidate) - referrals made at a later stage may not be valid
• To qualify for a reward, your referred friend must be referred and placed within a 12 month period
• Hays shall only accept referrals for people with the right to work in the UK and who are actively seeking an employment opportunity in Education. You warrant and confirm that your referral meets this criteria (a “Valid Referral”).
• You will be eligible for your gift 4 weeks (“Qualifying Period”) after your referred candidate commences employment in a temporary or permanent job
• Once your friend successfully completes their qualifying period please contact your local office to receive your vouchers
• Hays accept no responsibility for vouchers not successfully received due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind
• Hays has no liability for lost or stolen or e-vouchers, once the voucher is received by you
• Hays reserves the right to offer an alternative reward of the same value at any time
• Only those seeking an Education role may be referred under this Scheme.

UK Education Terms and Conditions

Please read below to understand how our refer a friend scheme works.

The Hays Refer a Friend scheme is limited to referrals of personal contacts ("Friend"). You must not refer any person under this scheme where you gained or developed the relationship through your employment, office, agency or any other position you may hold, or where referring the individual breaches any duty you may owe to any other organisation or person. To do so may amount to a criminal offence.

By referring any person under this scheme:

• 1. You warrant and confirm that the referral does not breach any duty you (or any third party) may owe to any other person or organisation (due to any expectation on you to act in good faith or impartially, or because you are in a position of trust) arising out of any:
  1. a) function of a public nature;
  2. b) activity connected with a business, trade or profession;
  3. c) activity performed in the course of any person’s employment (including yours); or
  4. d) activity performed by or on behalf of a body of persons (whether corporate or incorporate)
• 2. You warrant and confirm that your Friend has read and understood the Hays Privacy Policy. In accordance with Hays Privacy Policy, you warrant and confirm that you have the permission of the Friend to submit their details for this referral.
• 3. You agree to refund on demand (without any time limit) any reward where you are found to be in breach of these terms.
• 4. Hays shall not be liable arising out of or in connection with this agreement or (i) any loss of or damage to profit, revenue, savings, data, use, contract, goodwill or business or (ii) any indirect or consequential loss or damage, in each case howsoever caused or arising.
  • 4.1. The term "howsoever caused or arising"when used in this Agreement shall be construed widely to cover all causes and actions giving rise to liability, including but not limited to (i) whether arising by reason of any misrepresentation (whether made prior to and/or in this Agreement), negligence, breach of statutory duty, other tort, breach of contract, restitution or otherwise and (ii) whether arising under any indemnity and (iii) whether caused by any total or partial failure or delay by Hays.
  • 4.2. Nothing in this Agreement shall limit or exclude any party's liability for fraud or for death or personal injury caused by the negligence, or to the extent otherwise not permitted by law.
  • 4.3. The scheme is open to all UK residents aged 18 years or over, except employees of Hays Specialist Recruitment Limited (“Hays”) their families, agents or any third party directly associated with administration of the scheme.
  • 4.4. This scheme is free to enter and no purchase is necessary.
  • 4.5. Each Valid Referral entrant will receive one £350 Lifestyle voucher valid at multiple retailers, subject to retailer availability.
  • 4.6. The voucher will be sent to the entrant by email within 30 days of submitting their Valid Referral.
  • 4.7. The voucher is supplied by Motivates Inc. Ltd, a company registered in England and Wales under Company registration number 11319734 whose registered offices are at 3 Bath Place, London EC2A 3DR (the "Supplier"). Hays reserves the right to replace the voucher with an alternative prize of equal or higher value if circumstances beyond Hays’ control makes it necessary to do so.

   

  Additional Terms for referral entry additional prize draw

  • 1. The prize draw is open to all UK residents aged 18 years or over, except employees of Hays Specialist Recruitment Limited (“Promoter”) their families, agents or any third party directly associated with administration of the prize draw.
  • 2. The prize draw is free to enter and no purchase is necessary.
  • 3. All entries must be submitted via the scheme form and only one entry per person is permitted.
  • 4. The opening date for entries is 09:00 on 26^th January 2024. The closing date of the prize draw is 09:00 on 31^st October 2024. Entries received after this time will not be accepted.
  • 5. The Promoter accepts no responsibility for entries not successfully completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind.
  • 6. A winner will be chosen by random draw by an independent person on 07 November 2024 ("Draw Date").
  • 7. The winner will receive one £500 Lifestyle voucher valid at multiple retailers, subject to retailer availability.
  • 8. The winner will be notified by email or telephone (using details provided at entry) before 07 December 2024 and must provide a postal address to claim their prize. If a winner does not respond to the Promoter within 3 business days of being notified by the Promoter, then the winner's prize will be forfeited and the Promoter will be entitled to select another winner in accordance with the process described above.
  • 9. The prize will be sent to the winner by email within 30 days of being notified of their win.
  • 10. The prize for the winner is non-exchangeable, non-transferable and no cash alternative is offered.
  • 11. The prize is supplied by Motivates Inc.   • 13. The winner's surname and county can be obtained by sending an email to marketingsupportuk@hays.com within 30 days of the closing date of the prize draw.
  • 14. Participants are deemed to have accepted and agreed to be bound by these terms and conditions upon entry. The Promoter reserves the right to refuse entry, or refuse to award the prize to anyone in breach of these terms and conditions.
  • 15. The Promoter reserves the right to hold void, cancel, suspend, or amend the promotion where it becomes necessary to do so.
  • 16. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
  • 17. Winners may be required to participate in publicity related to the prize draw which may include the publication of their name and photograph in any media or social media.

  • 19. The prize draw will be governed by English law and entrants to the prize draw submit to the jurisdiction of the English courts.
