CPD units: 1Knowledge area: Substantive lawIn this interactive module Adrian Coorey, Principal Lawyer, Australian Competition and Consumer Commission & General Editor, LexisNexis publications, Competition and Consumer Law News, and In-house Counsel will discuss:- A brief overview of the consumer guarantees regime in Ch 3, Pt 3-2, Div 1 of the Australian Consumer Law (ACL) and the consumer guarantee remedy regime in Ch 5 Pt 5-4;  - A brief explanation of s 29(1)(m) of the ACL and discussion on selected recent decisions on false or misleading representations in relation to rights and remedies under the consumer guarantees;- Current difficulties with consumers obtaining remedies from suppliers and manufacturers for consumer guarantees failures; and- Proposed reforms of the consumer guarantee regime, including:    + Prohibit manufacturers from failing or refusing to indemnify suppliers;    + Prohibit suppliers from refusing to provide remedies to consumers where there has been a major failure to comply with a guarantee;    + Prohibit manufactures from retaliatory practice against suppliers for seeking to enforce their indemnification rights; and    + Introduce civil pecuniary penalties for contraventions of the prohibitions above, and provide the ACCC will the power to issue infringement notices where there is reasonable grounds to believe a contravention has occurred.Facilitator: Adrian Coorey, Principal Lawyer, Australian Competition and Consumer Commission & General Editor, LexisNexis publications, Competition and Consumer Law News, and In-house CounselRecorded: 27 March 2025
