As we reflect on the past year, it is still unclear as to when the extension of the public sector IR35 legislation changes will be introduced into the private sector. Although only a footnote in the budget, it has been confirmed that it will be extended to the private sector following consultation.

These legislation changes mean that the responsibility for determining whether or not an off-payroll worker falls in or out of IR35 is now with the hiring organisation, as is any liability for tax/NI contributions.
